Vacation Buy-Out Program

I'm trying to help my son out with a problem - He worked in Bucks County and recently took a job offer in Florida. He gave his former employer 2 wk. notice, but asked to use any unused vac. time. They replied ''no'', they needed him to train others. His final check they withheld $$ indicating vac. buy-out - you don't use it, you lose it! They can't show anything in writing to back this up and say it's their rule. Does he have any alternative course of action? We have been in touch with them, and they say it's all up to the payroll dept. lady, who is ''cut & dry''. Please help him out, every penny counts and this is $457. Thanks in advance.

You son may have a case under the Pennsylvania Wage Act. The act provides penalities of up to 25% and possible recovery of attorneys fees. You son needs to make a written demnand for payment of unpaid wages, namely the vacation time which was earned and not paid. If they fail to respond, suit under the act may be brought.
