Legal Question in Personal Injury in Pennsylvania

College harassment of fraternity

I am in a fraternity on a small college campus and recently we have been accused of handing out date rape drugs to girls at parties that are being held at our house. This is the second time this semester that we have been accused of this and both have turned out to be completely false. We feel that the school and the accusers are harassing us and ruining our character by posting notices around campus about this happenings when in fact they are not true at all. Do we have any case against the school or the girls for harassment or defamation of character?

Re: College harassment of fraternity

It is my firm belief that your fraternal organization absolutely has a valid action against the false accusers or anyone posting false information on signs. Whether or not the school has any liability is a different question, and one that is difficult to answer without getting into a deeper discussion of the facts.

A situation very similar to this happened to a friend of mine back when I was in college and I can recall how upset he and his brothers were over it. In time, his situation blew-over, and his fraternity just let it go. Depending on how upset you are and whether you think this will continue, you should get together with your brothers and make a decision whether or not to talk with an attorney. I recommend contacting the local bar association and contacting at least two or three attorneys for initial consultations. Good luck.
