Legal Question in Personal Injury in Pennsylvania

Deposition, location

In a personal injury lawsuit, does Pennsylvania require that the deposition of the injured person be conducted in the county in which they live or work? Or, is it required that the deponent traveled to Pennsylvania (from Florida) at their own expense?

This usually comes up in the context of a motion to compel discovery. If the defendant can get a court order requiring a deposition in Philadelphia, plaintiff has to come to Philadephia or risk having the suit dismissed. If plaintiff cannot travel, plaintiff may have to pay defendant's attorney, and possibly the defendant also, attorney fees and travel expenses to attend a deposition more than 100 miles from Philadelphia.
