law suit against older relative (mother)

Hi

My mother was in an accident about 1.5 years ago. she made a left turn in front of a young man who slammed into her vehicle. EMT where there everyone was fine. Of course he is pushing for a settlement claiming all kinds of stuff. she claims he was speeding and there was plenty of room between them when she turned. anyway, I am concerned for her health. blood pressures up, she's old and very upset. I understand that this person may be due some compensation but he has taken action against the insurance company and my mom. Can I sue him to protect her or for fear that he action is putting her health in danger? sorry if i haven't worded this very well.

Do not sue him, that would be a huge mistake. If he was injured, and if there is even a shred of proof that your mother is at fault, then he is entitled to bring a lawsuit against her. If you sue him, it would be considered malicious because you have absolutely no right to sue him. He could then in turn sue you for the malicious commencement of a lawsuit. I applaud that you are trying to help your mother, but a lawsuit here is the absolute wrong thing to do.

You (and your mother) do not have a reason to sue the other party just because he filed a personal injury lawsuit and you would prefer he did not. On the other hand, you should make sure the attorney defending your mother knows of the circumstances concerning her health so he or she understands the situation and does not put her under unnecessary stress.
