Legal Question in Real Estate Law in Pennsylvania

mortgage company says were behind but were not

We are haveing a problem with our mortgage company. They say we are 5 months behind on our mortgage but we make monthly payments.EMC had bought it over a yr ago and we had nothing but problems w/them.It seams like they just want to take our house. We did catch up on the past taxes and paid them over 8 grand to do so. Now they want to raise it up 700.00 to make it 1,500. when we are only to pay 900.00 a month. They seam to have reritten the mortgage. Can they do this? What can we do to save our home and our credit? We can't get a straight answer from anyone at the company. What legal action can we take on this? We can not even refinace the house to get out from under this company.

Re: mortgage company says were behind but were not

It is impossible to answer your question without a complete review of the history and documentation surrounding your default. Under Pennsylvania law there are certain requirements needed before a lender can institute a mortgage foreclosure action. It is my suggestion that you have an attorney review your situation in depth and provide you with a recommendation. Your situation is to complex to provide a simple answer on Lawguru. If I can be of any assitence please let me know. Gerald Hershenson
