Legal Question in Real Estate Law in Pennsylvania

One property, deeded to three siblings

Dad passed away a month ago and my two brothers and I discovered that he deeded to the three of us the home we grew up in. It has fallen into disrepair but in order to sell it we are willing to put some money into it. The problem is the one brother does not want to have any part in helping to pay for the repairs. When the house is sold can my other brother and I recoup the money that we invested into the house from his third?

Re: One property, deeded to three siblings

I suggest that you obtain a written agreement from the brother that does not want to contribute to allow your recoupment of costs from his share. You need his consent to obtain a sale and to sign the deed. If he refuses you should consult legal counsel to bring a partition action to force a sale of the real estate. That is more expensive because the court will appoint a trustee to conduct the sale and he is entitled to a fee. However, the costs of the sale will be addressed if that happens. More information is needed before any detailed advice can be given. If I can be of any assistence please call. Gerald Hershenson Esq. 215-579-9390
