Legal Question in Real Estate Law in Pennsylvania

Terminating a Rental Agreement

I signed a rental agreement back in September of 2006. I am in the process of buying a home which I will be closing on November 21, 2007. I spoke with my landlord, via the telephone, on November 9, 2007, about terminating our lease on December 15, 2007. They replied that the lease requires a thirty day notice, which I am giving them, but she added that I must pay for the full month of December. I foresee a hard time on getting out of this lease by the 15th. Are they legally right by saying that I must pay until the 31st of December? The only item stated on the lease is a 30 day notificationupon terminating a lease.

They have my security deposit and they were nice enough giving me their place for a short period of time. I'm just trying to be fair and get my security deposit back and not have to pay an extra 16 days.

Please Reply Brad

Re: Terminating a Rental Agreement

Generally the 30 day notice period runs from the beginning of the month to the end of the month unless the lease states otherwise if it is a month to month lease.

Good luck to you.
