Unclaimed property/never heard from executor

My grandmother was murdered by my mother when my brother and I were minors. We were placed in foster care. We just found unclaimed life insurance.-from what I understand, we are the heirs. How would I find the executor of the estate so the treasury can release the estate? We are both well over the age of 21 and have never heard from the executor-but were able to claim our granmother's pension when we were 21. Any ideas? Thank you.

If the life insurance names your grandmother's estate as the beneficiary, then you must search the records of the applicable courts for the executor. If no one has filed an estate, you and your sister may petition to be named co-executors to claim your benefit.

If the policy has a named beneficiary, the beneficiary should apply for the benefits. If this was your mother (as beneficiary) she would lose her rights. If the estate was the beneficiary, the estate representative must apply. Check with the Surrogate's office in the county where your grandmother was living when she died to see if any estate proceedings were ever processed> If so, they will know who was appointed and how to contact that person. If there were no proceedings, presuming you are the closest living relatives, you can apply. If there are living aunts and uncles, they have priority and should apply. If there are no aunts and uncles, but other grandchildren, they have equal rights to apply. If you have other questions, contact me directly.

If you are the beneficiaries of the life insurance policy, you don't need the executor. You should be able to deal directly with the company.
