Legal Question in Workers Comp in Pennsylvania

Can I separate from my job in order to have access of my 401k because I absolutely have no money until the workers comp case is solved.

Yes, but risky because there would be an offset against your workers' comp on a pro rated share basis based upon the employers' comntributions and the work comp carrier will likely argue you retired so your not entitled to wage loss benefits because you removed yourself from the labor market. There are ways to protest yourself from such risks. Your attorney can explain those to you.
