Legal Question in Criminal Law in South Carolina

minor in posession of alchol

My 20 year old son was given a ticket for M I P. He was with a friend who was over 21. Who was driving my sons car. Neather were drinking. They ask my son if they could search his car and he said yes. In the very back under a golf bag as well as baseball equenment they found a crushed ''old'' beer can.It must of falling from the golf bag (I;m not sure about this). I'm the one that most likely left it in the bag. We cannot afford a lawyer and were told a public defender does not handle these kind of cases. Any advise, And the friend that was driving was arrested and told his license were suspended but the next day when they were released they said they were wrong and sorry and let him go.

They ususally don't charge a person with MIP if the can was empty. Open Container maybe. Your son is entitled to a trial, but that is not advisable without an attorney. Your son may qualify for a program such as PTI, which if he received and completed, he could keep his record clean. Your welcome to call if you have any other questions. There are a lot of lawyers that wouldn't charge very much money for a case this small. I have done it in the past for only a few hundred dollars. Good luck.
