Legal Question in Criminal Law in South Carolina

Simple Posession Ticket

I recently received a simple posession ticket. It is my first offense. I know other people who were able to do PTI and I REALLY don't need this on my record. What qualifies you for PTI? Is it worth hiring an attorney?

Re: Simple Posession Ticket

You probably don't need to hire an attorney to get PTI. Simple Possession is a charge that can go through PTI, if you'd like to do that. You need to contact the Solicitor's Office (the PTI program is usually listed in the phone book) and make an appointment with the PTI coordinator. If you have any kind of record, they will not accept you. You have to pay a fee to apply for PTI, and then if you are accepted, there is another fee. The PTI coordinator will do a background check and ask the officer if he has a problem with you doing PTI, etc. If accepted, you will have to do community service hours and perhaps some type of counseling. After you complete the PTI, your record will be clean, and you can apply for the arrest to be expunged from your record. The whole process from application to completion takes about 6 months.

Let me know if you have further questions.
