Legal Question in Disability Law in Tennessee

possible wrongful termination

I've been on SSDI for about 9 years and have been able to keep a part time job witha company.I got where I could no longer peerform many of the job requirements but, the company has provided a job I could do. They have done this for at least 4 years. I now have a manger who has decided that if I can't do all the job requirements I would be fired.

She gave this to me in a memo address to me. I am filing with EEOC. Am I going in the right direction or wasting my time?

Re: possible wrongful termination

You are doing the right thing. The first thing you must do is file a claim with the EEOC. Please pay attention to what they tell you. They may give you directions or make requests of you, be very cooperative with them. While the EEOC is investigating your claim you should continue to look for an attorney to represent you. If the EEOC declines to take your case, which they often do to their heavy caseload, you want to be ready to go with an attorney already on board if possible. You may receive a "Right to Sue Notice" from the EEOC. Once you receive it you will only have 90 days to file a complaint. If possible you want to already have found an attorney by that time so you don't have to spend some of that precious time looking for an attorney. You may also have state law claims which are not covered by your EEOC filing. You want to have an attorney review those as soon as possible. Good luck.
