Is change of custody legal

if a custodial parent is living out of state, and the non custodial parent whom the 7 year old child has only seen 3 times in his life,and the non custodial parent files for full custody without a means of notifying the custodial parent, and somehow the court rules for change of custody. is it legal? the non custodial parent did not even have visitation rights.

I can think of at least one scenario where an order like that would be valid. However, if you were not given notice, the other parent knew where you were and there was no emergency, I would think the court would entertain a motion to set the order aside.
