What is the max the state of tn allows

I was rear-ended and state farm is trying to deny my claim. I was told that the max amount I can sue for is 15,000.00. My medical bills have exceeded that. Is this a civil suit, do I take it to small claims? Help!!!

I believe your are refering to general sessions court. That court has a 15,000.00 max at this time. Circuit court has not limit. (unless you are dealing with a government entity) When did the accident occur? What are your injuries? You can email me directly at [email protected]

IF you have been rear ended and have injuries related to the accident, you have a good case no matter what State Farm is telling you. The minimum policy limits in Tennessee is $25,000.00 so you have at least that much. If the person who hit you is from out of state and the minimum limits of that state is only $15,000.00, his policy is "re-formed" by law to the $25,000.00 limits of Tennessee. If you have underinsured motorist coverage with your auto policy, then your policy limits may add to the defendant's policy limits. You also need to see if you auto policy has Medical Payments coverage...that way, you can get some of your medical bills paid. I would be happy to discuss your case with you. Bill Poland
