Legal Question in Construction Law in Texas

contract law

I contacted a Tom Martino recommended company on 5/19/2004 and got a bid for $18,000 I told them at the time that I was going to get other bids and that I would get back with them , on 6/15/2004 I did contact them that I would accept their bid and on 6/16/2004 I signed a contract for the agreed upon price of $18,000 , but now on 6/17/2004 they said they made a mistake and the new price would be $21,500 , is this legal ! I have e-mail documentation of all contacts.

Re: contract law

It might be legal. However, assuming you could legally hold them to the $18,000 do you really want to do it? I can guarantee that they'll get their additional money in one way or another, and the both of you will be miserable.

If you declare that their revised bid is a breach of contract, you can go with the next higher bid, then look to the breachor for the price difference. If the difference is under $5,000 you can use Small Claims, and you don't need a lawyer.

Just make sure that their proposal didn't require review and approval by one of their officers after you indicated acceptance, since that would get them off the hook.
