Legal Question in Credit and Debt Law in Texas

credit card charge offs

I have had several credit cards which were charged off about 3 to 4 years ago. But I have had letters from different collection agencies trying to collect this debt.

1. Once the orginal debt is charged off, can different collection agencies still bother you?

2. Do they sell your ''Debt'' to other agencies if they dont get any thing from you?

3. Does each of these collection agencies report to credit reporting agencies?

4. I have been divorced for 3 years, how can I ''Start Over''?

Re: credit card charge offs

1. Yes; charging off is merely an internal accounting activity. It does not mean you do not owe the debt. However, there is a four year statute of limitations to sue on a debt. Sounds like some of the credit cards may be outside that. But, it can stay on your credit report for seven years from date of last activity.

2.Yes 3.More than likely. You can send a letter to a collection agency telling them to cease and desist from any and all communications with you, that, pursuant to the Fair Debt Collection Practices Act, you prefer to deal with the original creditor. Never negotiate with a collection agency.4. You might want to consider contacting a credit counseling agency. Most of them are scams, even CCCS. One I can recommend is First Stone Credit Counseling.
