Legal Question in Criminal Law in Texas

Hi I was being represented by a court appointed attorney on a MTAG. He got the MTAG dismissed and also asked that the Judge still consider granting me early termination from probation. He then got with the secretary and set a date for Dec. 15, next Wednesday. Yesterday I called my attorney to confirm and he said that the court has paid him for representing me and if I need further assistance from him on Wednesday that his fee is $750. I'm broke that is why the Judge appointed him in the first place. I was under the assumption that this attorney was appointed to me until the end of probation. What do I do?

I do not understand why this attorney set up a court date while he was appointed to represent you and then said you would have to pay him to go to the court that date. If that is true, there is something about that that does not sound right. I have not heard of a MTAG. A MTRP is a motion to revoke probation. I am assuming you are talking about a motion to revoke probation. If so, an attorney is appointed for that motion only and once it is deal with, the appointment ends. If you want to ask for early termination, many attorneys consider that as not extra work for pay, but rather a part of the original appointment. If I were you, I would try to tell the judge about this, that the attorney set up a court date for early termination but then said you would have to pay him for it. Frankly, that does not smell right. Ask the judge if he would appoint an attorney for you for purposes of early termination.
