Legal Question in Criminal Law in Texas

Texas Criminal Background Check-for apt

I am planning on moving into an apt complex that does criminal

background checks on it tenants before they rent an apt. In order to live in this complex, you cant have a felony conviction. Do you know how far back they will go to check this? My husband has a felony conviction from 1984-20 years ago for a marijuana charge. He served three years probation, and was released. I am wondering if this will show up? Also, I am currently on deferred adjudication for theft by check. I will be finished by June of this year. Will THIS show up on the background check? Thanks for your asisstance.

It depends on what agency they use for their background check. Any felony conviction can stay on your record indefinitely unless sealed or expunged. The court has deferred judgment in your theft case and it will be dismissed if you successfully complete probation. It could show up as an arrest but not as a conviction at this point.
