Legal Question in Family Law in Texas
Name change of a minor
I moved to South Carolina from Texas. I am wanting to change my daughters last name to the same as mine. I am the only parent on the birth certificate. Her father signed nothing stating that he was her father. He made it very clear that he would not do that until a paternity test was taken. But she has his last name. How can I go about changing this? Do I have to contact him? It was a very violent relationship and that is why I am here now. How can I go about this?

Re: Name change of a minor
The courts have made getting a name change more difficult in recent years due to people changing their names to avoid creditors and criminal prosecution. The procedure is the same regardless of whether your child is 17 or 2 years old. Most people now hire a lawyer to do it since it requires numerous legal documents, knowledge of court procedure, etc. The attorney fees involved are relatively inexpensive.
