Legal Question in Family Law in Texas

I am trying to divorce my husban but he's been giving me th run-around. Back in Oct he agreed to sign a waiver so tht we could get this over quickly and painlessly. We don't have any kids and we don't have any property to divide. The last address he gve me was in Florida. So after about 9 months of him sending me incorrect paperwork and saying things were lost in the mail, I decided to go through a process server. The process server says she has attempted. Number of times to deliver the petition but he is never there. The person who does live there says he knows him and he knows how to get in touch with him, but he isn't living there right now. What are my options to get this over with already??? He's obviously not going to cooperate. Can I go to court with proof of the attempts to serve him? Can someone else at the residence sign for him?

You should hire local counsel to assist you with asking the court to approve an alternate form of service.
