Legal Question in Family Law in Texas

House Debt regards to a divorce

Possibly getting a divorce, house loan in my (wife) name only, husband wants to keep house. Husband says that the divorce decree will rule. I say I wont be able to purchase another house because HIS house would be in my name. Is it okay to leave it in my name?

Re: House Debt regards to a divorce

If I understand your question correctly, the loan is in your name. No court can interfer with a third party creditor (mortgage company). Therefore, you will be liable for the mortgage. The husband needs to re-finance the house in his name only.
