Legal Question in Family Law in Texas

My husband and I divorced in December 2010 and I agreed for him to have the home. I have received the Special Warranty Deed papers to sign, but have not done so for the fact that I am waiting for him and his attorney to send over my QDRO papers for my awarded settlement. They have refused to send the forms to my attorney until I release the warranty deed papers. I do not want the home. Since I am still part responsible for the home could I go back and move in until all papers are signed? What rights do I have? What do you recommend the best option to do in the situation?

You need to talk to your attorney. I would call your attorney on Monday and be in his/her office next week.

If the judge has signed the final paperwork & your divorce has been finalized you really need to meet with your attorney and discuss your options.

Unfortunately by waiting this long, you have put yourself in a bad position regarding your options.

The QDRO & Special Warranty Deed should have been all signed at the time the Final Decree of Divorce was submitted to the Judge.
