no visits for 9 months, Can I ask that his visitation be modified?

divorced in 1997 he was ordered to pay CS for 2 kids and has standard visitation. I remarried in Feb, 2002 and the problems started...Ex quit his job and lost ins. on kids. started missing weekends and stopped paying child support.

Quit a 2nd job when served with WWO. Don't know where or if he is working now. Ex is an admitted alcoholic.

In Oct of 2002 I went to the attorney general for help.

we now have a court date in April 2003 to enforce an exsisting order. My ex is now over 14,000 behind on CS the boys have no health insurance and have not seen or heard from thier dad in 8 months. we have tried calling him but he will not answer the phone or return any of thier calls or any e-mails. Our 7 yr. old is angry and confused, but he still loves and misses him and wants to know why? Our 10 yr old is a different story, He has never had a bond with my ex and in the past 8 months has felt great relief he has not HAD to go for any visits. Is there any way the court would modify his visitation, even if it were just till the boys feel comfortable being around him again, it will be 9 months since they have been with him when we go to court??????

The AG's Office is most interested in child support matters. Don't know how much they will want to get involved in custody matters. You always have the option of hiring an attorney to deal with both. Things would probably get done faster and more efficiently due to the massive workload of the AG.

You always have an option of filing a motion to modify custody. The court will decide the matter on what is best for the children based on the facts specific to your situation.
