Discovery Request

I just received a notice that a court date was set in my case. I am the defendandt. I received the notice too late to request discovery material and less than 45 days before trial. I am going to motion for Continuance. Should I go ahead an serve my requests for discovery material even though the deadline under level 2 will have expired by 1 or 2 days? I hope I made that question clear. Thank you, kindly.

I can't answer your question without reviewing your case, but if you waited until a trial date was set to request discovery, you are way behind the power curve and have a serious problem. Discovery should have been requested as soon as you were sued. I recommend that you contact an attorney immediately. Call your County Bar for the attorney referral service, they may be able to refer you to an attorney.
