Legal Question in Civil Litigation in Texas

Slander/libal

I would like to know if Brady Center/Hand Gun Control Inc. can be sued for slander/libal. Their veiws and statements about gun owners being potential felons and potentially violent is untrue. These statements make the general public have a bad outlook on all gun owners. Law abiding gun owners should not face the same scrutiny as criminals.

Sure, except it'll be thrown out for any number of reasons. If there was a legal angle that could be used to bury those organizations, rest assured the NRA would have done so.

Yes you can sue the organization, but most likely will thrown out before you get to trial, either by a challenge to the pleadings or by summary judgment against you. Also, you most likely will be unable to find an attorney who will file the suit for you [unless you pay him cash in advance].

If you got to trial you would need to show damages. What are your damages?

Also, truth always is a defense, and generally mere opinion statements constitute a defense. To analyze your statement, It would be difficult to prove as an absolute fact that gun owners are not potential felons and potentially violent. Statistics show that most felons were not felons until AFTER they acquired their gun, and some of the best people with the best intentions go astray.
