Legal Question in Immigration Law in Texas

Hello ,

My fiancee ( legal immigrant) and myself an american citizen are planning to get married in US.Which Visa form would we have to fill and can we file for adjustment of status at the same time? Can he leave the country after filing for his green card? and if so in how many days can he leave?How much time does it take to get EAD? and green card?

Hi,

All sponsorship petitions and applications such as petition for alien relative, adjustment of status application, employment authorization and advance parole document applications, biographic questionnaires, affidavit of support, etc. are filed concurrently with the USCIS. If filed properly and on a timely basis, your fiancee can continue to remain legally in the U.S. even after I-94 expires, as well as be employed and have ability to travel (about 3 months after filing) and enter the U.S. again while the sponsorship paperwork is being adjudicated.
