Legal Question in Employment Law in Texas

All female group denied salary/benefits

I work in a small company of about 6 restraunts (Individually owned with investors) They are legally considered seperate intities but have the same name, food, etc. All of our Office Assistants, which is our current title, are women. We have all the responsibilities of an Office Manager but are denied management salary & benifits. They use us under they're management budget lines for pay & vacation, we also have management accessibility to all systems but we carry out daily management responsibilities/consequences. We deal with all employee legal issues and documentation, payroll, etc. Our responsibilities involve independant decisions to be made. We feel that we are being discriminated against because they don't want to have to pay us salary/benefits.

We recently came together as a group (5 of us) have submitted a formal request to the VP and Controller for a change in our behalf.

We have been told in response that ours is an hourly position no different that our busser or bartender. I am confident that our role is that of a manager ''Office Manager'' and the definitions that I have looked up reflect that as well.

My question is what can we do or use in defense of our case. Do we have one at all.

thank you

Re: All female group denied salary/benefits

You certainly may have a claim under the Fair Labor Standards Act. You should contact an attorney with expertise in this area and explore the facts in depth.
