Landlord-tenant dispute

Can the landlord make me pay the cost of removing and replacing a dead tree which was dead when my family and I moved in 4 months ago. The home owner's association is requiring the tree to be removed and replaced, which will cost me about $200-$400. My lease requires me to maintain the yard such as mowing, fertilizing and trimming the yard, controlling pests and weeds and removing debris.

It would be an interesting lawsuit. I think the outcome would favor you. I do not see a judge ruling that the language in the lease involves anything other than routine maintenance, and a reasonable person would not include the dead tree as routine maintenance. Especially if you had proof of the condition at move-in. (pictures, inventory sheet, witnesses, neighbors etc).
