Legal Question in Personal Injury in Texas

On April 24, 2010 I was on my way to work for a Census meeting in Corsicana Texas. It was 9:30 in the morning. I was a virtual stand still because of traffic, and all of a sudden a car rammed me in the rear of my car. The woman that hit me had no insurance, and was driving with a suspended license. My 2003 Nissan Altima was totaled, and I had to go to the emergency room for back and head pain. There, they did 2 MRI's and I was given 2 different pain/muscle spasm medications. They released me, and I drove myself home. What can I do...besides already filing a claim on my insurance. I want to sue her for the loss of my car and pain and suffering. I have not been the same since the accident. I have family members that will testify to that. I still have back pain, and am mentally scared to drive. This was the 3rd time that this 34 year old woman has done this...driving with a suspended licence and no insurance. They took her to jail after she was treated and released from the hospital in Corsicana Texas. Thanks for your help.

I'm sorry to hear about your accident. If you have uninsured motorist coverage, then your insurance company will basically act as the at-fault driver's insurance company. I can also run a search to determine if there was any insurance on the vehicle that hit you, there may be a different owner than the driver.
