Legal Question in Personal Injury in Texas

Automobile accident police report.

What do you do when you are in an auto accident, and the original police report doesnt say you were in the vehicle involved in the accident? When infact you were in the car accident. The other party had insurance and they have tried contacting me, since the report doesnt show my presence they dont want to compensate my lost wages or my therapy,

what do I do?

Police reports are not ironclad. Officers are human and make mistakes. As such, you can contact the officer and explain the situation and see if he will amend his report. You can also hire a local attorney to try to resolve this matter for you as well. It sounds like in your case, one of the witnesses would be the driver of the vehicle you were in.

This should not be a serious problem, if the insurance company will be reasonable.

The other driver should remember how many people were in your car, and can tell his insurance company. The driver of your car can make a statement to the insurance company, explaining that you were in the car. Or you could talk with the officer and ask him/her to revise the report.

The police report is a helpful tool, but it is not the final word on the facts of the case.
