Legal Question in Traffic Law in Texas

I have a question about a traffic accident. Today I sideswiped another vehicle. We pulled over and exchanged insurance information. I knew I was at fault and did not want to recieve a ticket so when he didnt suggest police involvement neither did I. Later, I realized that he was driving without a license, was not listed on the insurance, and could quite possibly have not been a licensed driver at all as he was very young with several kids in his car. However, no police report was filed so all of the information I gave him and all that he gave me is simply between me and him and the people we had in our cars. Can anything actually come of this situation? Will I be liable and will I be able to present the fact that he was driving without a license and uninsured as a stable argument to not be liable?

If no one was injured, I do not believe that you need to call the police. However you must exchange drivers license and insurance information.

I am not sure that driving without a license imposes liabilty for property damage caused by someone else or excuses that person from the damage they cause.

Report the accident to your liability insurer. Chances are if this guy was driving without a license, and without insurance, he will not file a claim against you since he would be admitting to these offenses if he did.
