I am the mother of a minor child who carries my maiden name. Parental rights of the biological father were not and will not be established. However, in the event that I am unable to care for my minor child or meet my demise, what is the best way to establish who will be designated as the legal guardian?

A will that states who you want to be the guardian of your minor child, and the trustee of the child's estate.

Speak with a lawyer that handles will preparation. This is not something you want to do yourself because the downside risks are too high.
