Legal Question in Bankruptcy in Utah

?

I unfortunately might have to claim bankruptcy. I have about 4500 in unsecured credit card debt. I have another 4000 in medical/other debt. I also have about 130,000 in debt from a house that I had to give up and let the company forclose on.

my question is can I claim the house since technically a house is not an unsecured debt or do I have to wait until they resell the house and claim whatever they want over what they sold the home for?

You can declare the house without waiting for the final foreclosure and deficiency.

You would list the debt on the house now. You would not need to wait to determine what the house sold for at foreclosure. There might also still be a chance to save the house from foreclosure depending on how much time remains before the actual foreclosure. I don't know if saving the house is an option for you but I thought I should at least mention this. I would be happy to speak with you in more detail about your situation.
