Re: Maliciousandwounding

If charged under 18.2-51, it can be a class 3 felony which carries: 5 to 20 years and a fine of not more than $100,000. if, however, the act is done "unlawfully but not maliciously"..then its a class 6 felony, which carries one to five years

imprisonment,or, up to 12 months in jail and a find of not more than $2,500.00. It is the serverity of the injury imposed that makes the diffrence. Please note: if the injury

is permanent and significant phyusical impairment

results, under 18.2-51.2, a class 2 felony is imposed with a possible sentence of life or any term not less than twenty years and fine to $100,00.00. Again its the serverity of the injury that matters. good luck. If you have been charged with this crime, get a lawyer.
