First time DUI questions about sentencing

I was just pulled for a DUI on my motorcycle. I had forgotten my helmet and I just got out of my housing development when I realized I didnt have it and that is when the officer saw me. I am over 21 and was tested at .09 BAC and spent the night in jail. I have no infractions on my record, no priors of any type with alchohal, and cooperated fully with the police. I was wondering what type of conviction can I expect with this situation. Mostly, Jail time?, License restriction?, and Community service. I am sure ill get a decent fine and have to take the course.

The likely disposition of your case would depend in part on where the arrest occurred but if it was in any of the larger NoVa jurisdictions it may go something like what follows:

Fine: $1200 to $1500 with perhaps $800 to $900 suspended;

Jail: 30 days or so, all suspended since your BAC was below .15;

Driver's license suspended for 12 months with restricted privileges available upon proper request;

Completion of the ASAP program and possibly some community service;

Payment of all fines/costs by the stipulated deadline.

Since DUI is a jailable offense you should have

appropriate defense counsel representing you. If you cannot afford to hire such on your own, you should request that the court appoint one to represent you in this matter.
