Legal Question in Family Law in Virginia

Pregnancy outside of Marriage and Divorce

I recently found out that my husband has gotten his girlfriend pregnant. He has refused a PSA on the grounds of he wants money from me for a vehicle in his name that was purchased during the marriage. I've been the only one to pay anything on the vehicle, and when I gave it back to him to have it sold, he had it voluntarily repossessed. Now he wants me to give him money for the negative equity. He also is insisting that I give him back a camera that he gave me for Christmas last year, and will sign no papers until I do so. Will I have to pay him money in light of the fact that he has another family now while we are still married? Should I file for an uncontested divorce and just hope that he goes along with it, or file for a fault divorce? I want exactly nothing from him, except for a divorce and to be able to move on with my life. Thank you in advance for your responce

Re: Pregnancy outside of Marriage and Divorce

You could always file for the no fault divorce(assuming you meet the required criteria), and if your husband refused to cooperate in completing a PSA, the court could then be brought into the process to adjudicate the equitable distribution of the marital property.

You could also later amend the original no fault complaint to one alleging fault grounds if it were determined to be a feasible strategy at that particular stage in the case.
