Legal Question in Landlord & Tenant Law in Virginia

Getting Kicked out with less than two weeks notice

I live with two other gentleman, only one person is on the lease. We all pay equal amounts and I have been living there since June of 2004. I was aproached by the genleman on the lease that he wants me out before the 1st of this month. He says its because of a few circumstances but me and the other roomate know its because his girlfriend is moving in and wants to use my room as storage. What right do I have in proper time and if I move out on short notice is there any way I can sue him to compensate for moving cost and emotional stress? I was led to believe that to kick someone out you need to do it in writing and give at least 1-2 months. So basically I want to know what rights I have not being on the lease and if I could sue him for mistreatment. Thank you for your time, I look forward to listening to some good info. Ken

Re: Getting Kicked out with less than two weeks notice

On a month to month lease, you are entitled to 30 days notice that the lease is being terminated. He cannot kick you out unless he does that. No you cannot sue him for emotional stress or the moving costs.
