Legal Question in Consumer Law in Washington

car dealership not paying off the trade in car loan.

a car dealership is trying to say that the pickup that my daughter bought with them as the lender has been stolen by her. the first payment is not even due yet and we have the loan papers soaying that they financed it at 10 percent interest. we have the release of interest signed by them and her and the papers that factor in the trade in in the new loan. they have not paid the car off yet and say they wont because they think she had no intention of paying for the pickup. even though she did and the first payment is not even due yet. how can we make them pay the trade in car loan off. it is also in my mothers name and she was never even informed of this till after they gave my daughter the loan. they have also given myself and my mother info on the pickup like the vin number and amount and payment amounts. which is a breech of her privacy. only my daughters name is on the pickup. i think they are bluffing but dont want to take a chance. they say that they have reported the pickup stolen and have warrents out for my daughter and her new husband yet the police say no report was filed. we are at a loss of how to approach them.do they have the right to not pay off the trade in car loan?

Re: car dealership not paying off the trade in car loan.

You have a right to call the attorney general for consumer protection and discuss this situation with that office.

You can find them at the state's home page of www.access.wa.gov

Something is not right. There should be a paper trail showing the entire transaction. Please be prepared to show this to the AG's office, or if necessary, private counsel.

Many consumer protection oriented lawyers will talk with you for free so they can evaluate your case with the documents. You need someone local, though.

Your local Bar Association may have some ideas for referrals for you. Hope this helps.
