Legal Question in Consumer Law in Washington

Company refuses to give full refund

I purchased a large screen tv. Returned it 3 days later. They refused to take it back for refund because box was opened. Said: Credit only. On the 30 day refund policy #1 says If for any reason you are unhappy return it for a FULL REFUND or exchange within 30 days. Units must bae factory sealed. #2 says Open-box units may be returned for exchange credit only, providing in as-new condition with original packing and accessories. When I brought it back, they said it has been opened so they would not give me a FULL REFUND like in number 1. Do I have any recourse toget my FULL REFUND or does number 2 take effect because box has been opened? PLEASE let me know and what I have to do to get my money refunded in full. I am on SSI. Thank you

Re: Company refuses to give full refund

You can take a copy of the store's refund policy to small claims court and sue them. If the judge agrees with you, then you can get your refund. If the judge does not agree with you, you could be ordered to pay them.

Sounds as though option number two is what happens because the box was opened.

You have to decide whether this is worth the risk, and only you know what your risk tolerance is.

The State doesn't require merchants to promise to take back merchandise for full refunds under any circumstances. Sounds to me as though the policy is clear and they followed their policy.

Hope this helps. Elizabeth Powell
