restraining order

My ex girlfriend who has not been living with me and is not on the rental agreement just got me kicked out with a restraining order what can I do to get back my home?

I do not understand, if your ex does not live with you and obtained a restraining order against you, why can't you go home? Do you mean that she just moved in but is not on the lease? If so, you should have a return hearing for your restraining order, usually within two weeks of the date you were served.

At the return hearing, you will present your side of the case and the judge or commissioner will decide whether to allow the restraining order to remain in effect or dismiss the case. The judge may also allow the restraining order to remain in effect but provide for you to return home and the ex to move out, given the situation with it being your place.

Restraining orders, particularly those that are domestic violence protection orders can lead to criminal charges (if the cops were called out) so I advise you to seek out local counsel to help you on this.
