Legal Question in Civil Litigation in West Virginia

While I was studying abroad I had my mail forwarded to my mother's address. In December I realized that she had stolen my identity through my credit cards and maxed them out. When I confronted her about it she pleaded with me not to contact the police and she agreed to pay me back. However, the amount she charged on my credit card was 5000 USD and she has only paid me back 1200 USD.

Can I bring a civil case against her. If so, how long does it usually take and what kind of fees are associated with it?

You're seriously going to sue your mother? You should find a better way of dealing with this than the courts.
