Legal Question in Sexual Harassment in Wisconsin

I want to know if this is some type of sexual harassment...help!

For the record,I am not homosexual,I am simply a straight male who cares quite a bit about his appearance. That being said, the assistant manager at my place of work likes to spread rumors about me,the first one was that I was a homosexual, the second one was that I frequently crapped my pants at work(this is a 26 year old man spreading these) and the third one was once again that I was a homosexual. At my workplace,we are required to work every other weekend,we just hired two more people to work on my weekend, both homosexual males,my manager that works my weekend is also a homo sexual, the manager thats been spreading these rumors works opposite of me.Just this morning at work,he and I and someone from a different department were talking, and he had mentioned how everyone on my weekend are all ''fags'' including me,and when I tried to clear the air by saying I was straight, and he replied with,''oh bullshit, you like to play with just as much shit as the rest of those queers do,you fuckin faggot.'' He's creating a hostile work envioroment. This type of behavior has been going on for far too long, and quite frankly I can't take it anymore, he has been talked to twice before in the past for starting this rumors and I want someone to take action!

The supervisor's behavior is bad and may border on sexual harassment. Based on what you've said, I can't give you a definite Yes answer. However, he has no business telling people you are a homosexual - whether its true or not. He has no business talking in such a nasty way to you either.

The first thing to do is complain once more to Human Resources. Let them know very clearly it bothers you and that you find the behavior as harassment. See what they do next and whether the supervisor stops. If not, talk to an employment lawyer about whether this behavior is bad enough to constitute sexual harassment. I'm sure you can find an employment lawyer who'll provide a low cost or no fee consultation.

On a related note, you should talk to a personal injury lawyer and consider perhaps suing the manager for defamation.

Hope this helps.
