Legal Question in Banking Law in India
A mortgagor/guarantor to the loan transaction is died. One of the legal heir who got transferred the mortgaged property of his father is the sole proprietor of the firm who borrowed money from bank. What is the course open to the bank to continue the business? Can the bank ask all legal heirs to execute further a fresh mortgage?

Dear Sir / Madam,
Yes, the Bank is entitled to execute a fresh mortgage from all the legal heirs for continuing granting of facilities to the main borrower who is the sole proprietor of the concern.
