Legal Question in Consumer Law in India
My son was driving my car. My wife was sitting along as co driver. My wife has a valid driving licence but my son does not have a valid driving licence. since he is only 16 years of age. An accident took place and the fault is completely of the motorcycle rider. There was much damage to my car as the motorcyclist banged to the car right side door. now because of the humanitarian ground my wife took the rider for first aid and also paid some money to him for his damage. What is the legal position of the case. i.e should we do the FIR and claim the repair charge from the insurance company.

you can claim insurance provided you show it is driven by your wife and not the minor without DL.
