Legal Question in Criminal Law in India
I have been accused in a case under S 420 etc. It has been 15 years since then and for the past 5 years the prosecution has neither examined any witness in fact the APP has noe made a single appearance in this period . Three judges have changed and the last judge closed the prosecution case abd the defence presented its arguments. A significant fact is that two PWs have failed to appear for Cross by the defence We have filed a petition for return of property seized at the time of arrest. # months ago the prosecution filed a petion under S 311 for examining some witnesses but even after 17 dates has failed to appear before the court. Please advise (a) What recourse does the defence have in this matter &(b) under what Sec of CrPC can my property seized be restored to be

this is a sensitive matter and any option without going through the FIR, charge sheet and evidence would be worthless. it is advisable to see a lawyer in person.
