Legal Question in Family Law in India

Hi,

Recently I found that my husband is having an affair with a woman.

I am varsha kakkar from delhi.

Married to Mr Rajeev Kakkar.

We have been married for almost 12 years, and have two girl child. Both below 8 years. Everything was going fine, till i found out about the extra marital affair of my husband. When i confronted him, and asked him about this, he denied having any such thing. however, i am confirmed, and i have valid proofs against him to prove his affair. I even have news that he wants to marry her, and even his family members are supporting him in this. So option of involving family members has been opted out. And he will not listen to my parents. He has given no money at home for almost 2 months, so it is becoming difficult for me to survive. Also, from past few days, he is coming home very late, and sometimes even not coming to home. For my kids he is saying that he will send them to boarding school. i want the relation to continue for the sake of long happy married life and my childrens. Kindly advise, what steps should be taken by me, and whether i should resort to any legal recourse in this condition.

yes it is better you file a case under the domestic violence act and get the maintenance amount per month for yourself and your children, further there are many other reliefs in Domestic violence act which you can apply if necessary like, injunction that your husband should not marry, to deduct amount from his salary and be paid directly in court or your account towards maintenance, not to sell the property which you are residing or any other reliefs which you require,
