after seven months if an application to withdraw first divorce petition with liberty to institute a fresh petition under 0.23 rule 1(3) of the code of civil procedure 1908 is submitted in family court, then is there are chances to accept the application with compensatory cost ?? and also how compensatory cost is decided ? can u told me in details about acceptance and rejection of application. Is accepted how many % chances is? if rejected why so????

if the petitioner is seeking the permission to withdraw the divorce petition then it is the discretion of the court to allow it or not. I dont think costs are awarded in such matters.
