Legal Question in Employment Law in India
Dear Sir,
I am working in a MNC in India as Assistant Manager.
I have resigned my job to join in another company. During my notice period I have downloaded chemical safety data sheets from company intra-site to keep it in share folder for easy acess of my juniors.
This activity was monitored by the IT-staff and reported to Management. Management says that it is confidential data downloaded. Hence my job was terminated for code of conduct.
I explain to the management the purpose of downloading the data sheet and all these details available in Google site also, but they did not accept.
I am requesting relieving letter so that I can join in my prospective employer, but they are not ready to give, but giving termination letter only.
Kindly advise me how to proceed further.

Dear Sir / Madam,
You should explain to your prospective employer the circumstances in which your services were terminated by your present employer and request them to overlook your relieving letter. Simply inform your new employer that the Company issued you a termination letter out of disgust and grudge that you had quit, and on a flimsy excuse just to save on the notice period salary that they would have to pay you for.
