Legal Question in Employment Law in India
Iam working in IT startup company in cochin kerala.manegement said that for manufacturing company working hours is 8 hours or 48 hours in weekly.but for IT company working hours can extended to 10hr and want to give a break after 5 hr.is there any exception for IT startup companies for working hours? What is the maximum working hour for IT startup companies perday and also weekly..what are the consequences for companies who break this law?please help me to solve my doubt?.

Dear Sir / Madam,
As already advised, the 8 hours per day 48 hours per week rule as per the Labour Law is common to all factories and establishments in all industry segment without any special exceptions or exemptions for working hours in an IT Company. If the Company does not compensate its employees for the additional extra hours per day worked, every officer of the Company associated and responsible for this violation remains liable to a fine / penalty and / or simple imprisonment.
