Legal Question in Employment Law in India
My wife works for a school affiliated to ICSE. She has resigned on March 28th and is supposed to serve a notice of 3 months. She will work till May 13th till the summer vacation starts which is one and half months. She is willing to pay one and half months salary however the school says that she needs to join back after the holidays for atleast a day else two and half months salary would be deducted. I am not sure what is the legal basis for the same.

Dear Sir / Madam,
Since you wife has submitted her letter on resignation on 28.03.2014, her last working date in the school remains 27.06.2014. At times, despite summer vacation, the School Principal calls a group of teachers to complete certain administrative matters related to the school, besides evaluation and completion of submission of examination answer sheets of all students. If your wife is willing to pay one and half month's salary to the school, which has been specifically mentioned in her letter of resignation, I see no reason why the Principal should not relieve your wife from the close of school hours on 13.05.2014 as it is a "Win Win Situation" for both, your wife and the school.
